Studie má za cíl představit strukturu Hayekova evolucionismu. Argumentace postupuje v několika krocích: Východiskem je historicko- systematická expozice způsobu, jakým evoluční teorie ovlivnila Hayekovu filosofii, především s ohledem na periodizaci vývoje jeho myšlení a systematické odlišení explanans a explanandum v rámci jeho teorie vědy. Dále je rozebírán způsob, jakým Hayek rozvíjí svoji metodologii vědy. V této souvislosti je argumentováno ve prospěch teze, že Hayekovo pojetí metodologického dualismu je důsledkem ovlivnění evoluční teorií. Zároveň je evoluční teorie představena jako nástroj vysvětlení, konkrétně (...) pak tzv. vysvětlení vzorce. Následně je představeno Hayekovo pojetí společnosti v kontextu kulturní evoluce. Společnost je interpretována jako řád jednání a je kladen důraz na Hayekovo vnímání společnosti jako řádu vyvíjejícího se společně s lidskou myslí. Na základě těchto předpokladů je v poslední části rozvinuto Hayekovo pojetí mysli. Toto pojetí vychází z konekcionistické pozice. Dále argumentuji proti tradičnímu pohledu na Hayekovu filosofii jako rozvíjení Kantovy filosofie. Závěr rekapituluje základní body Hayekova evolucionismu. (shrink)

The focus of the research is to develop recommendations of smart specialization (SS) for Ukrainian policymakers using European approaches. The authors revealed that the main SS projects are presented in such sectors as agri-food, industrial modernization and energy. More than 12 EU countries were the plot for conducted analysis of SS, as a result of which the level of activity of each country was determined. The creation of consortiums, including SMEs, associations, universities and other participants, disclosed the successful way of (...) SS realization. The structure of SME’s innovative potential in Ukraine was identified underlining their main characteristic features like types of innovations and innovative activity, differentiation according to enterprise size, their regional distribution. The authors explored lack of innovations on regional and national level and significant territorial disparities, which could be eliminated through policy implementation of regional SS. The existing legislative norms for possibility of SS implementation in Ukraine were analyzed due to correspondence with the EU ones. The analysis provides the opportunity to consider them only as general framework documents without any action plans and sectoral prioritization at all. The weak points of these law documents are emphasized. As a result of research, the authors developed recommendations presented by direct action plan for Ukrainian policymakers, which include such activities as underlining key priorities (especially ICT applicability in every SS project) and their correspondence with the EU ones; eliminating regional imbalances by focusing on innovation development and reorientation of some regions according to SS priorities; respecting regional existing capacities; providing organizational mechanism for cooperation of stakeholders and financial mechanism for SS support through the EU structural funds. Roman Catholic and Eastern Orthodox theologians claim that the unique event of Christ’s sacrifice on Calvary is present in Eucharistic liturgies. A popular explanatory strategy for this miraculous presence suggests that due to its supernatural character the Eucharist “conquers time,” transcends its boundaries, and allows for temporal coincidence of two chronologically distant events. I discuss the four main approaches within this strategy that can be discovered in contemporary theological writings. The first approach implies a time travel of the Calvary event. (...) The second suggests the time travel of Eucharistic participants. The third eliminates the chronological distance by relocating one of the events into a timeless reality. The fourth assumes multilocation of the event across time. I argue that each of these approaches is untenable on philosophical or theological grounds. (shrink)

Efforts to bridge emotion theory with neurobiology can be facilitated by dynamic systems (DS) modeling. DS principles stipulate higher-order wholes emerging from lower-order constituents through bidirectional causal processes cognition relations. I then present a psychological model based on this reconceptualization, identifying trigger, self-amplification, and self-stabilization phases of emotion-appraisal states, leading to consolidating traits. The article goes on to describe neural structures and functions involved in appraisal and emotion, as well as DS mechanisms of integration by which they interact. These mechanisms (...) include nested feedback interactions, global effects of neuromodulation, vertical integration, action-monitoring, and synaptic plasticity, and they are modeled in terms of both functional integration and temporal synchronization. In response to historical challenges, advocates of a sophisticated variant of scientific realism emphasize that theoretical systems can be divided into numerous constituents. Setting aside any epistemic commitment to the systems themselves, they maintain that we can justifiably believe those specific constituents that are deployed in key successful predictions. Stathis Psillos articulates an explicit criterion for discerning exactly which theoretical constituents qualify. I critique Psillos's criterion in detail. I then test the more general deployment realist intuition against a set of (...) well-known historical cases, whose significance has, I contend, been overlooked. I conclude that this sophisticated form of realism remains threatened by the historical argument that prompted it. Intensions feature prominently among the entities we talk about.

Scientific realists have claimed that the posit that our theories are (approximately) true provides the best or the only explanation for their success . In response, I revive two non-realists explanations. I show that realists, in discarding them, have either misconstrued the phenomena to be explained or mischaracterized the relationship between these explanations and their own. I contend nonetheless that these non-realist competitors, as well as their realist counterparts, should be rejected; for none of them succeed in explaining a significant (...) list of successes. I propose a related non-realist explanation of success that appears to be the most suitable among those considered. (shrink)

The article analyzes the aesthetic content of the concept of realism in stylistic, genre and ideological aspects. Guided by the comparative method and a comprehensive approach to the study of the problem, the author declares the a priori avant-garde nature of art and, as a result, the groundlessness of confrontation between realists and avant-gardists. The catharsis achieved by the realism of expressive means should be real. Thus, the author's vision of realism presupposes not so much the harmony of art with (...) the displayed epoch, but rather participation, confession of enduring values, which elevates art above the historical and social context. В статье анализируется эстетическое содержание понятия реализма в стилевом, жанровом и мировоззренческом аспектах. Руководствуясь компаративным методом и комплексным подходом к изучению проблемы, автор декларирует априорную авангардность искусства и, как следствие, беспочвенность конфронтации реалистов и авангардистов. Реальным должен быть катарсис, достигаемый реализмом выразительных средств. Таким образом, авторское ви́дение реализма предполагает не столько созвучие искусства отображаемой эпохе, сколько сопричастность, исповедание непреходящих ценностей, что возвышает искусство над историко-социальным контекстом. The Greek model of the Trinity, based on the Theological Orations of Gregory of Nazianzus, treats the Trinitarian relations as connections between the Father and the two other persons: the Son and the Holy Spirit. The two relations have to be heteronymous, and have to be interpreted from the extreme realistic position. The Latin Trinitarian model, based on Boethius’ De Trinitate, treats relations as three subsistent persons. The relations have to be unidirectional: from the Father to the Son, and from (...) both of them to the Holy Spirit. Both models are adequate and effective, but incompatible. One of the consequences of this incompatibility is the problem of filioque: the introduction of an additional relation of procession into the Greek model as well as the exclusion of this relation from the Latin model result in the inadequacy of the models. From the point of view of the complementability of a model, the Greek model allows introduction of new elements, while the Latin model does not. The soteriological consequences are such that the Greek model welcomes a human person to establish a unique relation with the person of the Father, which leads to the theosis of a creature. The Latin model requires the saving relation to be established with the whole Trinity, and theosis is not supported. (shrink)

Considering the whole set of social systems known to history, we can recognize a very interesting distinction that divides all systems into two large classes. This distinction is based on the degree of homogeneity of the political sphere of society, the extent to which representatives of the political class of the society separate themselves established on identity from the people under their control, on cultural distance between upper and lower classes.

Lawrence Kohlberg's Approach to Moral Education presents what the late Lawrence Kohlberg regarded as the definitive statement of his educational theory. Addressing the sociology and social psychology of schooling, the authors propose that school culture become the center of moral education and research. They discuss how schools can develop as just and cohesive communities by involving students in democracy, and they focus on the moral decisions teachers and students face as they democratically resolve problems. As the authors put it: "...we (...) propose an educational renewal of our democratic society.... We have attempted to establish schools that do more than just teach about democratic citizenship, that are themselves democratic societies.". (shrink)

Moral philosophers are, among other things, in the business of constructing moral theories. And moral theories are, among other things, supposed to explain moral phenomena. Consequently, one’s views about the nature of moral explanation will influence the kinds of moral theories one is willing to countenance. Many moral philosophers are (explicitly or implicitly) committed to a deductive model of explanation. As I see it, this commitment lies at the heart of the current debate between moral particularists and moral generalists. In (...) this paper I argue that we have good reasons to give up this commitment. In fact, I show that an examination of the literature on scientific explanation reveals that we are used to, and comfortable with, non-deductive explanations in almost all areas of inquiry. The article is devoted to the topic of "traces of the past” interpretation; its relevance is due to both the need to improve the training of history majors and the aggravation of the fight against falsifications of history (primarily domestic). The aim of the research is to analyze the correlation of humanitarian, social and technological components in the methodology of teaching historical disciplines. The comparative method was chosen as a key method. The work uses the method of hypotheses, content analysis (...) of the source base, and experience in studying University teaching practice. My book is about the human creativity being a source of progress, and cycling of evolution caused by platitude and triviality of once high-reaching idealism. In essence the book presents an original perception of human history, based on Christian values as vital coordinates system. I hope this book will revive the interest to the Russian school of thoughts and to humanism in general.

The article analyzes the phenomenon of ownership in its legal, economic, political and philosophical perspectives. Ownership is considered as an opportunity and as a guarantee of sustainable development. Comparative context is used to identify the specificity of the bourgeois model of owners’ power (social state) and the domestic concept of power-ownership (including socialist state). The author draws conclusions about ways to overcome the competition between the state and the market for the human resource and proposes to explore the ideological provision (...) of power-ownership in order to appreciate its progressive potential and predilection in relation to the liberal model of social development . The article deals with a pivotal conceptual distinction employed in philosophical discussions about global justice. Cosmopolitans claim that arguing from the perspective of moral cosmopolitanism does not necessarily entail defending a global coercive political authority, or a "world-state", and suggest that ambitious political and economic (social) goals implied in moral cosmopolitanism may be achieved via some kind of non-hierarchical, dispersed and/or decentralised institutional arrangements. I argue that insofar as moral cosmopolitans retain "strong" moral claims, this is an untenable position, and (...) that the goals of cosmopolitan justice, as explicated by its major proponents, require nothing less than a global state-like entity with coercive powers. My background ambition is to supplement some existing works questioning the notion of "governance without government" with an argument that goes right to the conceptual heart of cosmopolitan thought. To embed my central theoretical argument in real-world developments, I draw on some recent scholarship regarding the nature of international organizations, European Union, or transnational democratization. Finally I suggest that only after curbing moral aspirations in the first place can a more self-consciously moderate position be constructed, one that will carry practical and feasible implications for institutional design. In this paper I argue that internalistic foundationalist theories of the justification of memory belief are inadequate. Taking a discussion of John Pollock as a starting point, I argue against any theory that requires a memory belief to be based on a phenomenal state in order to be justified. I then consider another version of internalistic foundationalism and claim that it, too, is open to important objections. Finally, I note that both varieties of foundationalism fail to account for the epistemic (...) status of our justified nonoccurrent beliefs, and hence are drastically incomplete. (shrink)

G. A. Cohen conceptualizes socialism as luck egalitarianism constrained by a community principle. The latter mitigates certain inequalities to achieve a shared common life. This article explores the plausibility of the community constraint on inequality in light of two related problems. First, if it is voluntary, it fails as a response to “the abandonment objection” to luck egalitarianism, as it would not guarantee imprudent people sufficient resources to avoid deprivation and to function as equal citizens in a democratic society. Contra (...) Cohenite socialism, this appears unjust. Second, if it is instead enforced, coercive equalization beyond sufficiency-constrained luck egalitarianism, which is possibly necessary to achieve a shared common life, seems to require unjustified restrictions on liberty. I therefore argue that the constraint is most plausibly specified as requiring enforcement of sufficiency and only voluntary equalization thereafter. I also note, skeptically, why this constraint might be morally preferable to a purely sufficientarian alternative. (shrink)

his article will focus on the mechanistic origins of the computer metaphor, which forms the conceptual framework for the methodology of the cognitive sciences, some areas of artificial intelligence and the philosophy of mind. The connection between the history of computing technology, epistemology and the philosophy of mind is expressed through the metaphorical dictionaries of the philosophical discourse of a particular era. The conceptual clarification of this connection and the substantiation of the mechanistic components of the computer metaphor is the (...) main goal of this article. The statement is substantiated that the invention of mechanical computing devices, having a long history in the European engineering tradition, formed the prerequisites for the emergence of machine functionalism in the modern philosophy of mind. The idea of multiple implementation stems from the principle that a formal symbol system prescribes rules for the use of rational abstractions through the physical architecture of a computational engine. The article considers the reasons for the conceptual shift and reveals the semantic foundations for the metaphorical transfer of the properties of abstract objects from the theory of automata to the field of modern philosophy of mind. The criticism and ways of protecting the philosophical program of machine functionalism are analyzed by changing the content of the metaphor “Mind as machine”. The reasons for the stability of the information-computer approach in cognitive sciences are also disclosed and explained. (shrink)

The article analyzes the concept of serendipity as a property and state of personality. The approach chosen by the author is aesthetic; the problem is covered from the perspectives of pedagogy and didactics. The object of the study is the phenomenon of "intuitive serendipity", the subject is the methods of creativity development. Comparison of different types of thinking (inductive, deductive, paradoxical) allowed us to make a number of generalizing judgments. In particular, the superiority of "paradox logic" over formal logic and (...) the role of intuition and "sense of truth" in the process of cognition. On the basis of the conclusions it is proposed to discuss the author's hypothesis of the trigger principle of learning based on cultivating a craving for knowledge, ideological immunity and the ability to independently search for and analyze information, as well as to implement it in the creative process. В статье приводится анализ понятия серендипности как свойства и состояния личности. Выбранный автором подход — эстетический; освещение проблемы в ракурсах педагогики и дидактики. Объект исследования — феномен "интуитивной прозорливости", предмет — методики развития творческого потенциала. Сравнение различных типов мышления (индуктивное, дедуктивное, парадоксальное) позволило выйти на ряд суждений обобщающего характера. В частности — о превосходстве "логики парадокса" над логикой формальной и о роли интуиции и "чувства истины" в процессе познания. На основании выводов предлагается обсудить авторскую гипотезу триггерного принципа обучения, основанного на культивировании тяги к знаниям, идеологического иммунитета и способности самостоятельно искать и анализировать информацию, а также реализовывать ее в творческом процессе. Now it is plain that such consequences as these conflict sharply with common-sense notions of morality. If we had been obliged to accept Psychological Egoism, in any of its narrower forms, on its merits, we should have had to say: 'So much the worse for the common-sense notions of morality!' But, if I am right, the morality of common sense, with all its difficulties and incoherences, is immune at least to attacks from the basis of Psychological Egoism.

The article analyzes approaches to the ethicalization of officialdom in the realities of digitalization. The author believe that demonstrative behavior harms the authority of public service. Administrative ethics should be based on traditional values, the main of which are deemed to be integrity and loyalty to the Motherland. The normative and metanormative pluralism that figures among core self-descriptions of democratic theory, which seems incompatible with democratic theorists’ practical ambitions, may stem from the internal logic of research traditions in the social sciences and humanities and in the conceptual structure of political theory itself. One way to deal productively with intradisciplinary diversity is to appeal to the idea of a meta-consensus; another is to appeal to the argument from cognitive diversity that fuels recent debates on epistemic democracy. According to many philosophers, psychological explanation canlegitimately be given in terms of belief and desire, but not in termsof knowledge. To explain why someone does what they do (so the common wisdom holds) you can appeal to what they think or what they want, but not what they know. Timothy Williamson has recently argued against this view. Knowledge, Williamson insists, plays an essential role in ordinary psychological explanation.Williamson's argument works on two fronts.First, he argues against the claim that, unlike knowledge, (...) belief is``composite'' (representable as a conjunction of a narrow and a broadcondition). Belief's failure to be composite, Williamson thinks, undermines the usual motivations for psychological explanation in terms of belief rather than knowledge.Unfortunately, we claim, the motivations Williamson argues against donot depend on the claim that belief is composite, so what he saysleaves the case for a psychology of belief unscathed.Second, Williamson argues that knowledge can sometimes provide abetter explanation of action than belief can.We argue that, in the cases considered, explanations that cite beliefs(but not knowledge) are no less successful than explanations that citeknowledge. Thus, we conclude that Williamson's arguments fail both coming andgoing: they fail to undermine a psychology of belief, and they fail tomotivate a psychology of knowledge. (shrink)

In this article the linguistic processes of consciousness are discussed at the informational and semantic levels. The key question is devoted to the distinction between the information, meaning and sense in the physical, logico-semantic and historic levels of brain and consciousness. The principal point runs that the human linguistic process of sense producing takes the variety and indistinctness in the cultural presupposition. The modern theories of philosophy of mind relying on the theories of Soviet psychological school propose some new solutions (...) in the pragmatic questions of the semantic noncomputability. Philosophers and theologians acknowledge that "fideism" is difficult to define but rarely agree on what the best characterization of the term is. In this article, I investigate the history of use of "fideism" to explore why its meaning has been so contested and thus why it has not always been helpful for resolving philosophical problems. I trace the use of the term from its origins in French theology to its current uses in philosophy and theology, concluding that "fideism" is helpful (...) in resolving philosophical problems only when philosophers scrupulously acknowledge the tradition of use that informs their understanding of the word. Laws of nature seem to take two forms. Fundamental physics discovers laws that hold without exception, ‘strict laws’, as they are sometimes called; even if some laws of fundamental physics are irreducibly probabilistic, the probabilistic relation is thought not to waver. In the nonfundamental, or special, sciences, matters differ. Laws of such sciences as psychology and economics hold only ceteris paribus – that is, when other things are equal. Sometimes events accord with these ceteris paribus laws (c.p. laws, hereafter), but (...) sometimes the laws are not manifest, as if they have somehow been placed in abeyance: the regular relation indicative of natural law can fail in circumstances where an analogous outcome would effectively refute the assertion of strict law. Many authors have questioned the supposed distinction between strict laws and c.p. laws. The brief against it comprises various considerations: from the complaint that c.p. clauses are void of meaning to the claim that, although understood well enough, they should appear in all law-statements. These two concerns, among others, are addressed in due course, but first, I venture a positive proposal. I contend that there is an important contrast between strict laws and c.p. laws, one that rests on an independent distinction between combinatorial and noncombinatorial nomic principles.2 Instantiations of certain properties, e.g., mass and charge, nomically produce individual forces, or more generally, causal influences,3 in accordance with noncombinatorial.. This paper offers a general characterization of underdetermination and gives a prima facie case for the underdetermination of the topology of the universe. A survey of several philosophical approaches to the problem fails to resolve the issue: the case involves the possibility of massive reduplication, but Strawson on massive reduplication provides no help here; it is not obvious that any of the rival theories are to be preferred on grounds of simplicity; and the usual talk of empirically equivalent theories misses (...) the point entirely. (If the choice is underdetermined, then the theories are not empirically equivalent!) Yet the thought experiment is analogous to a live scientific possibility, and actual astronomy faces underdetermination of this kind. The success of the atheistic hiddenness argument depends on the “consciousness constraint” it imposes on the divine-human loving relationship: namely, that this relationship requires human conscious awareness of being in the relationship with God. I challenge the truth of this proposition by introducing the concept of a physical relationship with God that is not subject to this constraint. I argue, first, that a physical relationship with God is metaphysically possible; second, that its plausibility is supported by natural theology; and third, (...) that a perfectly loving God would prefer physical relationships with human beings over consciousness-constrained relationships, because a perfectly loving God would prefer to preserve the integrity of human freedom of participation and allow inclusion of all people regardless of their natural cognitive capabilities. The article highlights the problem of studying historical time in terms of aesthetics and social ethics. The essence of history, according to the author, is not so much in retrospection or reflection, but in the gap between feeling and awareness. Guided by the apophatic method, the author analyzes the historiosophical views of domestic and foreign scholars and comes to the conclusion that the Soviet paradigm is true, where the only vector of human development is the liberation of labor in the (...) name of creating a bright future for the sake of all people and for everyone -/- . Plato’s Timaeus gives an account of the creation of the world and of human race. The text suggests that there was a first generation of human beings, and that they were all men. The paper raises difficulties for this traditional view, and considers an alternative, suggested in more recent literature, according to which humans of the first generation were sexually undifferentiated. The paper raises difficulties for the alternative view as well, and examines the third possibility, advocated by some ancient as (...) well as modern interpreters, according to which there were no first humans, strictly speaking. Although the latter view avoids the pitfalls of the former two views, it crucially rests on a metaphorical reading of the creation story in the Timaeus. (shrink)

If two theory formulations are merely different expressions of the same theory, then any problem of choosing between them cannot be due to the underdetermination of theories by data. So one might suspect that we need to be able to tell distinct theories from mere alternate formulations before we can say anything substantive about underdetermination, that we need to solve the problem of identical rivals before addressing the problem of underdetermination. Here I consider two possible solutions: Quine proposes that we (...) call two theories identical if they are equivalent under a reconstrual of predicates, but this would mishandle important cases. Another proposal is to defer to the particular judgements of actual scientists. Consideration of an historical episodethe alleged equivalence of wave and matrix mechanicsshows that this second proposal also fails. Nevertheless, I suggest, the original suspicion is wrong; there are ways to enquire into underdetermination without having solved the problem of identical rivals. (shrink)

Employing the framework of conflicting goals in democracy promotion as departure point, the paper addresses the issue of arms exports to non-democratic countries as an important research topic which points to a reconsideration of certain fundamental conceptual and normative commitments underpinning democracy promotion. Empirically, we remind of the lingering hypocrisy of Western arms exporters, knowing that exports to non-democratic countries often hinder or block democratisation. This is not easily circumvented, because of the many conflicting objectives both internal and external to (...) democracy promotion itself. Yet democracy and human rights promotion remain, ethically and pragmatically, important policy goals. Noting that the self-evident character of the state-based liberal democratic model is being increasingly questioned in the literature, we then critically explore a radical if surprisingly natural alternative vision: Namely that if the commitment to democracy and human rights is to be genuine, only global democracy remains a viable way of resolving the many dilemmas, as it aspires to deal both with regulating arms exports and building of accountable decision-making structures. Although we ultimately reject the globalist solution and lean towards a less radical constructivist approach, we endorse the underlying rationale, namely that democracy promotion needs to sincerely embrace normative democratic theory. Using the original theory of social identity the article considers ethnicity, quasi-ethnicity, and nationality in a context of ethnopolitics. The article introduces logically strong definitions for mentioned identities, shows the possibility of exploding a nationalism basing on any quasi-ethnical social identity – with some historical examples. One non-banal result: the functions of nation in USSR were carried on by the Communist Party.

This paper is devoted to some generalizations of explanatory potential of connectionist approaches to theoretical problems of the philosophy of mind. Are considered both strong, and weaknesses of neural network models. Connectionism has close methodological ties with modern neurosciences and neurophilosophy. And this fact strengthens its positions, in terms of empirical naturalistic approaches. However, at the same time this direction inherits weaknesses of computational approach, and in this case all system of anticomputational critical arguments becomes applicable to the connectionst models (...) of mind. The last developments in the field of deep learning gave rich empirical material for cognitive sciences. Multilayered networks, mathematical models of associative dynamics of learning, self-organizing neuronets and all that allow to explain the principles of human conceptual organizing and after this to emulate these processes in computer systems. At all engineering achievements of this technology there is a traditional criticism from representatives of cognitive psychology who cannot accept a thesis about learning ability of a neuronet on the basis of redistribution of scales. Process of learning of natural intelligence, according to cognitive models, happens due to attraction of knowledge broadcast in a symbolical form (mental representations, concepts) at the expense of the systems of output knowledge expressed in the propositional contents. Some philosophical aspects of «neural metaphor» in modern cognitive sciences create the problem field which demands comprehensive understanding, the first step towards which is taken in this work. The article is devoted to the study of ideological and philosophical components correlation in the worldview formation. According to the author, it is fundamentally important to take for understanding Russian history and culture not speculative, but ideological coordinates as the basis. Ideology as a professed philosophy is incomparably higher than any palliative abstraction. It is necessary not to lower culture to the level of the masses, but to elevate a person to the level of culture, impossible without a cult.

Monists, pluralists, and particularists disagree about the structure of the best explanation of the rightness (wrongness) of actions. In this paper I argue that the availability of good moral advice gives us reason to prefer particularist theories and pluralist theories to monist theories. First, I identify two distinct roles of moral theorizing—explaining the rightness (wrongness) of actions, and providing moral advice—and I explain how these two roles are related. Next, I explain what monists, pluralists, and particularists disagree about. Finally, I (...) argue that particularists and pluralists are better situated than monists to explain why it is a good idea to think before we act, and that this gives us reason to favor particularism and pluralism over monism. Libertarian philosophy asserts that only the initiation of physical force against persons or property, or the threat thereof, is inherently illegitimate. A corollary to this assertion is that all forms of speech, including fraudulent advertising, are not invasive and therefore should be considered legitimate. On the other hand, fraudulent advertising can be viewed as implicit theft under the theory of contract: if a seller accepts money knowing that his product does not have some of its advertised characteristics, he acquires the (...) property title to the customer’s money without voluntary consent, which is theft. The balance between these two logical extensions of property rights—the right of free speech and the right of contract—lies somewhere in the area of communication philosophy, and can be explained through understanding the role of communication in human interactions. Advertising is a form of communication that may convey important information about the conditions of the proposed contract. These conditions are expressed in particular words that may have different meanings in different circumstances. Therefore to determine whether a particular example or “misinterpretation” is mere sophistry or a type of fraud, the judicial system has to approach each issue on a case-by-case basis. The border between legal and illegal should be determined by precedents and by expectations based on commonly accepted definitions of terms—what people commonly understand by the words and other forms of communication they use. The article is devoted to the analysis of the ideological component of legal consciousness. Legal ideas give meaning and weight to evaluative criteria in legal norms, develop legal intuition, which is higher than dogmatic knowledge and bureaucratic hookworming. Ideology saturates the legal form with humanistic content. Commitment to ideals does not emasculate the thinking of lawyers to constructions and algorithms. The author sees legal harmony in the combination of ideological maximalism with legal minimalism. Статья посвящена анализу идеологического компонента правосознания. Правовые (...) идеи придают смысл и вес оценочным критериям в юридических нормах, развивают правовую интуицию, которая выше догматического знания и бюрократического крючкотворства. Идеология насыщает юридическую форму гуманистическим содержанием. Приверженность идеалам не выхолащивает мышление юристов до конструкций и алгоритмов. Правовая гармония видится автору в сочетании идейного максимализма с юридическим минимализмом. (shrink)

The article overviews all known approaches to formalization of a problem of Liberty / Freedom (« Liberty from », « Liberty for », « being for her/his own sake, not a other's », « absence of sovereign other », individual freeing in a context of the Master-Slave Dialectics, Social Freedom) and problems of emancipation (« restricting privileges of upper class minorities », « giving privileges to marginalized minorities – affirmative actions »). Then, the article discusses a version of formalization of (...) level of social freedom through comparison of what is allowed for an individuals in the society with what is allowed for «a sheep in herd »: each additional degree of freedom gives unit in plus, each additional restriction gives unit in minus. The proposed model was tested for a case of the post-Soviet transit, when the level of freedom evolved from minus two for the USSR up to plus two for the contemporary Russian Federation. It also shows the ways for further emancipation of people in Russia in « politically easy version » - i.e. without essential change of its political system. (shrink)

The article critically covers the current issues of "value-driven management" and the creative economy. Analyzing the concept of a "fragile and incomprehensible" (BANI) world, the author conclude that the widely proclaimed era of the knowledge economy is nothing more than utopia. A value-based transformation is possible if it is approached in a comprehensive and systemic way, which requires large-scale transformations initiated and supported by the power structures. The author believe that the creative economy is more extensive than the traditional one, (...) and its development potential is rather limited. The paradigm of "commercial creativity", in fact, is aimed at providing employment and meeting the needs of the population of the "golden billion" countries. Статья в критическом ключе освещает актуальные вопросы «ценностного менеджмента» и креативной экономики. Анализируя концепцию «хрупкого и непостижимого» (BANI) мира, автор приходит к выводу, что широко провозглашенная эра экономики знаний — не более чем утопия. Ценностная трансформация возможна, если подход к ней будет комплексным и системным, для чего требуются масштабные преобразования, инициируемые и поддерживаемые властными структурами. Креативная экономика, как полагает автор, в большей степени экстенсивна, чем традиционная, а потенциал ее развития весьма ограничен. Парадигма «коммерческого креатива», по сути, нацелена на обеспечение занятости и удовлетворение потребностей населения стран «золотого миллиарда». (shrink)

There are two ways that we might respond to the underdetermination of theory by data. One response, which we can call the agnostic response, is to suspend judgment: "Where scientific standards cannot guide us, we should believe nothing". Another response, which we can call the fideist response, is to believe whatever we would like to believe: "If science cannot speak to the question, then we may believe anything without science ever contradicting us". C.S. Peirce recognized these options and suggested evading (...) the dilemma. It is a Logical Maxim, he suggests, that there could be no genuine underdetermination. This is no longer a viable option in the wake of developments in modern physics, so we must face the dilemma head on. The agnostic and fideist responses to underdetermination represent fundamentally different epistemic viewpoints. Nevertheless, the choice between them is not an unresolvable struggle between incommensurable worldviews. There are legitimate considerations tugging in each direction. Given the balance of these considerations, there should be a modest presumption of agnosticism. This may conflict with Peirce's Logical Maxim, but it preserves all that we can preserve of the Peircean motivation. (shrink)

Článek se zabývá způsobem, jakým vnímá vztah vědecké metody a demokracie Karl Popper. Toto sepětí je jedním ze základních atributů Popperova myšlení. Pro jeho pochopení je třeba zasadit Poppera do historického kontextu vývoje liberálního myšlení a poukázat na možné souvislosti se Schumpeterovou redefinicí demokracie. Výchozím bodem je však interpretace základních episte- mologických předpokladů Popperova myšlení - konceptů provizornosti vědeckého poznání a ratio negativa. Primárním cílem článku je kontextualizace těchto předpokladů s politologickými a sociologickými důsledky. Ty lze spatřovat nejen s odmítnutím (...) positivismu a esencialismu, ale také v Popperově preferenci volebních a stranických systémů. Na závěr je rozpracována problematika kritického racionalismu, hodnot a otevřené společnosti na základě možných námitek vůči Popperově teorii. (shrink)

The article provides an analysis of the views of Russian thinkers on historical progress; the concepts of freedom-opportunity, freedom-necessity, time and space are explored. Comparing the western and domestic approaches to the formation of the so-called "national idea", the author formulates his own hypothesis of progress, based on the creativity of the Person as conciliar unity.

Background theories in science are used both to prove and to disprove that theory choice is underdetermined by data. The alleged proof appeals to the fact that experiments to decide between theories typically require auxiliary assumptions from other theories. If this generates a kind of underdetermination, it shows that standards of scientific inference are fallible and must be appropriately contextualized. The alleged disproof appeals to the possibility of suitable background theories to show that no theory choice can be timelessly or (...) noncontextually underdetermined: Foreground theories might be distinguished against different backgrounds. Philosophers have often replied to such a disproof by focussing their attention not on theories but on Total Sciences. If empirically equivalent Total Sciences were at stake, then there would be no background against which they could be differentiated. I offer several reasons to think that Total Science is a philosophers' fiction. No respectable underdetermination can be based on it. (shrink)

During the last two decades the role of quantitative genetics in evolutionary theory has expanded considerably. Quantitative genetic-based models addressing long term phenotypic evolution, evolution in multiple environments (phenotypic plasticity) and evolution of ontogenies (developmental trajectories) have been proposed. Yet, the mathematical foundations of quantitative genetics were laid with a very different set of problems in mind (mostly the prediction of short term responses to artificial selection), and at a time in which any details of the genetic machinery were virtually (...) unknown. In this paper we discuss what a model is in population biology, and what kind of model we need in order to address the complexities of phenotypic evolution. We review the assumptions of quantitative genetics and its most recent accomplishments, together with the limitations that such assumptions impose on the modelling of some aspects of phenotypic evolution. We also discuss three alternative appr oaches to the theoretical description of evolutionary trajectories (nonlinear dynamics, complexity theory and optimization theory), and their respective advantages and limitations. We conclude by calling for a new theoretical synthesis, including quantitative genetics and not necessarily limited to the other approaches here discussed. (shrink)
